(1) All private businesses, private clubs or places of public accommodation herein required to be licensed for the conducting of social games shall at all times be kept in a clean and sanitary condition and shall be open at all reasonable times to inspection by any public officer for violations of the ordinance codified in this chapter or any other ordinance of the city of Yoncalla.

(2) There shall be no banked games or a game that establishes house or bank odds, nor games wherein the deal does not rotate. No games in which one player has an advantage over another shall be permitted.

(3) Each licensee shall establish and publish house rules; provided, that such rules do not conflict with the provisions of this chapter or the provisions of any statute of the state of Oregon.

(4) There shall be no “rule of percentage” or other fee or charge made or collected by the owner of the table, the premises or any other person.

(5) Poker games are a permitted social game; however, the maximum bet shall be $5.00 with a three-time raise limit.

(6) The game of “21” or “Blackjack” is permitted under the following conditions:

(a) No bank shall exist.

(b) The deal must rotate to a player who is dealt a natural “21,” commonly known as “Blackjack.”

(c) If the player who is dealt the natural “21” hand refuses the deal, the option to deal shall be offered to the other players, proceeding clockwise around the table, beginning at the left of the player dealt the natural “21” except that the prior dealer shall be the last player to whom the deal is offered.

(d) Upon demand of any player, the dealer must prove, before proceeding with the game, his or her financial ability to cover, in cash, all wagers on the table, including doubles for one hand of play.

(e) The dealer does not take “pushes.”

(f) No tips, donations or other compensation of any nature shall be paid to the dealer other than his or her winnings as a player.

(g) The maximum wager shall be $5.00, subject to double when posted house rules permit doubling down or splitting pairs. (Ord. 248 § 5, 1979; Ord. 199B § 7, 1974).
