(1) Playing or conducting of social games as defined in this chapter is hereby authorized within the corporate limits of the city of Yoncalla, subject to the provisions of this chapter.

(2) Definitions.

“House income” means any monetary net gain or advantage received by the house directly from the actual play of a social game or any income derived from acts which would constitute the promotion of gambling.

“Player” means a person who engages in any form of gambling solely as a contestant or bettor, without receiving or becoming entitled to receive any profit therefrom other than personal gambling winnings. A person who permits the use of his or her premises, cards, tables, or any other form of material assistance to the operation, conduct, or establishment of the game shall not be entitled to participate as a player in the game.

“Social game” means a game other than a lottery, between players in a private home, private business, private club or place of public accommodation where no house players, house bank or house odds exist and there is no house income from the operation of the social game.
