Not less than five days prior to the time set for any jury trial the municipal judge shall, in the presence of the parties, draw sufficient ballots from the jury box to prepare a list of nine prospective jurors. The names of persons known to be absent from the city, no longer resident therein, or incapacitated, may be rejected and a new ballot drawn. If the person whose name is drawn is known to no longer reside within the city of Yoncalla, the ballot shall be destroyed. (Ord. 245 § 6, 1978).
