Chapter VIII Ordinances
Section 33 Enacting clause.
The enacting clause of all ordinances hereafter enacted shall be “The city of Yoncalla ordains as follows:”
Section 34 Introduction, reading and passage.
Every ordinance of the council shall be fully and distinctly read in open council meeting on two different days previous to being put upon its final passage. Any ordinance, however, may be introduced, read twice, once in full and once by title, and put on its final passage at a single meeting by a unanimous vote with all members of council present at the meeting. Upon the final votes of an ordinance, the ayes and nays of the members of council shall be taken and recorded in the journal. If the ordinance passes, the recorder shall sign it with the date of its passage and his/her name and title of office, and within three days thereafter, the mayor shall sign it with the date, his/her name, and the title of his/her office.
Section 35 When ordinances take effect.
An ordinance enacted by the council shall take effect on the thirtieth day after its enactment. An ordinance may provide a later time for it to take effect, and in case of an emergency, it may take effect immediately, provided that any measure deemed an emergency measure, necessary for the peace, health and safety of the people of the city of Yoncalla, shall become immediately operative. Such emergency measure shall state in a special section the reason for its being declared an emergency measure and it must be approved by an affirmative vote of three-fourths of all members of the council.
Section 36 Violations of ordinances.
Violation of any ordinance of the city of Yoncalla is hereby declared to be a misdemeanor, and any person or persons violating same, upon conviction thereof, shall be punished by a fine and/or confinement in the county jail as designated in each ordinance.
